Terms and Conditions

Welcome to Internet Fixers (ABN: 90 309 143 981). By booking a technical service with us via our website, phone, WhatsApp, or any other method, you agree to be bound by the following Terms and Conditions.

1. Scope of Services & Impartiality

  • Services Provided: We provide independent, residential, in-home internet optimization, hardware installation, Wi-Fi troubleshooting, device configuration, and general domestic technical support.
  • Independence: We operate purely as an independent service provider. We do not sell internet plans, nor do we accept commissions or kickbacks from hardware manufacturers. Our recommendations are based solely on our independent evaluation of your property.
  • ISP & NBN Limitations: Where a fault is diagnosed as originating beyond your router (on the ISP or NBN network), we will provide you with diagnostic findings and an instructional script. We do not accept liability for, nor can we guarantee the response times or rectification actions of, third-party internet service providers.

2. Pricing, Bookings, and Payment Terms

  • Rates: Services are charged at an initial call-out fee of $150 for our standard service area (which includes travel and the first 60 minutes of on-site labor). Subsequent labor is billed at $100 per hour, calculated and tracked in 15-minute increments.
  • Pre-Authorisation & Variations: We will always discuss technical complexities with you transparently before exceeding the initial included hour or the quoted estimate. No additional billable hours will be incurred without your verbal or written consent on-site.
  • Payment Terms: Payment is due immediately upon completion of the on-site service. We accept major credit cards, debit cards, and mobile wallets via our secure on-site mobile terminal.
  • Disputed Invoices: If you genuinely dispute any part of an invoice, you must notify us as soon as practicable. You agree to pay the undisputed portion of the invoice immediately while we work in good faith to resolve the disputed amount.

3. Australian Consumer Law (ACL) Savings Clause

  • Consumer Guarantees: Our services come with statutory guarantees that cannot be excluded, restricted, or modified under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL). Nothing in these Terms and Conditions operates to exclude, restrict, or modify the application of any implied condition or warranty, the exercise of any right or remedy, or the imposition of any liability under the ACL where to do so would contravene the law or cause any term of this agreement to be void.

4. Limitation of Liability & Risk Allocation

  • No Exclusion of Core Liability: Subject to Section 3 (ACL Savings Clause), we do not exclude or limit our liability to you for physical damage to your tangible property, personal injury, or death caused directly by our proven negligence, faulty workmanship, or willful misconduct during the provision of our services.
  • Commercial & Consequential Loss Exclusion: To the maximum extent permitted by law, and subject to your non-excludable rights under the ACL, we will not be liable to you for any purely economic, commercial, or business-related losses. This includes, but is not limited to, loss of business profits, loss of business revenue, business interruption, or loss of commercial data arising from network downtime or service delays. This exclusion does not apply to reasonable personal disruptions occurring within a standard domestic working-from-home or remote schooling environment.
  • Data and Backup Responsibility: Technical troubleshooting, network modifications, and hardware installations carry an inherent risk of data loss or configuration corruption. While we exercise due care and skill, it is entirely your responsibility to back up all vital files, software, and device configurations before our technician arrives. To the extent permitted by law, we are not liable for data recovery or loss of unbacked-up data.

5. Access, Safety, and Customer Obligations

  • Safe Environment: You must provide our technician with a safe workplace, clear access to all relevant areas of the property, utilities, and networking components.
  • Supervision: An adult aged 18 or older must be physically present on the premises at all times during the provision of our services. We reserve the right to cease services immediately if the environment is deemed unsafe, hazardous, or hostile.

6. Force Majeure (Events Beyond Our Control)

  • Neither party will be liable for any delay or failure to perform its obligations under these Terms (other than an obligation to pay money owed) if the delay or failure is caused by a Force Majeure Event. This includes, but is not limited to, acts of God, severe weather events or natural disasters in the Illawarra/NSW region, regional NBN or telecommunications network outages, pandemics, government restrictions, or any other major disruptive event entirely beyond the reasonable control of the affected party. If a Force Majeure Event occurs, our scheduling obligations will be suspended for the duration of the event.

7. Governing Law & Severability

  • Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales in respect of any dispute.
  • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of law (including under the ACL or Unfair Contract Terms laws), that specific provision will be severed or modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
